Do Any of You Know a Lawyer That Takes Pro Bono Drug Casses?
Question by Mikes Brother: Do any of you know a lawyer that takes Pro Bono drug casses?
I am trying to find help for my brother. He is sitting in jail in San Jose for something he didn’t do. We have tried to get the PD to actually do something but he wants my brother to plea to something he didn’t do. The cops say he had cocaine in his mouth and that he was high when they stopped him. They drug tested him and he came up clean and now they refuse to test the bag of cocaine for his saliva witch could prove he didn’t have it in his mouth as they clam. We need a real lawyer to get them to test it and then they will have no evidence and have to drop the case. He is innocent and the test will prove it if we can get them to do the test.

The problem you might find is, there are so many drug cases and the lawyers who are willing to do pro bono work only have so much time to give. You might have a difficult time finding one.
It is apparent you are not happy with the public defender, but you must realize that if you want an OJ defense, you have to come up with the juice.

Why would a priovate attorney take such a case?
To them, there is not really much interesting about it.
If you can’t hire one, the Public Defender is your best option.
You can always go to trial.
Ask the PD if the evidence supports him at trial – clean drug test, failure to test the bag for DNA.
But why do they have a bag of cocaine anyway associated with him? Something seems missing here, as you didn’t even state the charge!
Still, since I am somewhat familiar with SJ, I would suggest that there are social service agencies, some geared towards particular ethnicites and some not, they may be willing to at least give you some leads on a pro bono or redued rate case.
I know one of them is AACI, on Moorpark. See AACI.org. Maybe someone there can guide you even if you are not Asian (their target clientele). I know there are Hispanic agencies too, and other non-ethnic ones as well. Just don’t recall all the names as I am not in SJ anymore.
Also, google “pro bono san jose” and see what you come up with.
