I live in San Jose, CA well my brother in law’s kid’s mother always comes over & throws dirty diapers in the driveway or other trash,she will start cussing & being loud & obnoxious for no reason.My bro in law has full custody of his kids because she had her rights takin due to her drug abuse.So he lets her see the kids but he really doesnt have to.She parks in our driveway for hours & talks on her phone loudly oh & when ever anyone comes over she harrasses them by calling them names & talking crap to them.She has been told to leave but always just comes back.
A restraining order is not in my budget right now & we do want the kids to see her because they do love her.
I know if I call the cops on her a few times she will stay away for a minute but she will just come right back.But since she’s a meth addict she’s paranoid about cops.
what are the CA laws for tresspassing?
or basically what do I do about this?

If she refuses to leave your property after you tell her to do so, that is considered trespassing and you are then within your rights to call the police.
