Is it mandated by state law, or is it the decision of the hospitals that they will only consent to grant medical care if the person be willing to undergo any test deemed necessary by the healthcare provider?

Edit: Good God! I can’t believe the Supreme Court hasn’t thrown that out–it’s a clear violation of the Fourth amendment!!! I guess the “right of privacy” only exists when it’s consistent with the agenda of the welfare state.

    Eighteen states mandate drug testing of newborns; Texas is one of them. The law is part of Texas Family Code, § 261.001 , the second source listed below. It was passed, in part, to allow for immediate treatment of newborns who may be born addicted due to the addiction of mothers.

    “18 states that have amended their civil child welfare statutes to address a pregnant woman’s use of controlled substances are Arizona, California, Florida, Illinois, Indiana, Iowa, Maryland, Massachusetts, Michigan, Minnesota, Nevada, Oklahoma, Rhode Island, South Carolina, Texas, Utah, Virginia, and Wisconsin.”

    if there is a suspition that the mother was using during pregnancy. i used to work with someone that got her son taken away because he had marijuana and cocaine in his system when he was born. also when the placenta starts to pull away from the uterus during pregnancy, that can be a side effect from cocaine use. if this happens the baby may be tested.
